Last week, President Donald Trump signed an executive order to end birthright citizenship for children of illegal immigrants and temporary residents.

While those outside of the legal community may be shocked by this move, its actually right in line with the opinions from the supreme court following their dissenting opinions on the abortion issue via  Dobbs v. Jackson Women’s Health Center, last year.

Justice Thomas mentioned that the 14th amendment wasn’t meant to be applied to abortion law, gay marriage law, or even immigration law, but explicitly for the descendants of those formerly enslaved.

Thomas argued that the 14th amendment was meant to ensure the children of those formerly enslaved would have rights as us citizens going forward following the end of the civil war.

For the amendment to be used and abused for all of these other purposes, most of which having nothing to do with Black people is not only immoral but Thomas argues, unconstitutional.

Alito second in calling the courts decision in 1973 Roe v Wade case was “egregiously wrong” primarily because abortion was never mentioned as a explicit right of liberty under the Due Process Clause of the 14th amendment.

Thomas went further stating that “this wasn’t the end”, implying that now that the court had correctly interpreted the spirit of the 14th amendment and properly applied it to its Black citizens, that every random issue that benefited off of the amendment will need to be revisited.

Trump correctly following up the rear of his judicial allies, stated on Monday that birthright citizenship was intended for those formerly enslaved, hinting at his possible willingness to craft executive actions for Freedmen in specific, and for the conservative court to reevaluate the 14th amendment, so that this 100 year old problem can finally be settled.

Trump may be hinting at reopening the Freedmen Bureau, a task sat before him by his Republican predecessors from over a century ago.

If President Trump and the conservative led Supreme Court are able to finish the decades long task of enshrining Black American’s rights, they may be able to rebuild the Republican party of reconstruction, the party that held super majorities for nearly 4 decades before Democrats reformed under the new deal.

The Democrats are already in a bad position, but if President Trump and Justice Thomas get their way, the Democrats may not even be a factor at all in the next decade.
